1. Agreement to these terms
These Terms of Service (the “Terms”) are a binding agreement between you and Limbo Inc. (“Limbo,” “we,” “us,” or “our”) governing your access to FlashTalk, including our mobile applications, websites, and related services (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use FlashTalk. You may not use the Service if applicable law prohibits you from doing so or if we previously disabled your account for violating these Terms.
By using the Service, you represent that the information you provide about your age and eligibility is accurate.
3. Accounts
You are responsible for providing accurate account information, keeping control of the phone number and device used to access your account, and notifying us promptly if you suspect unauthorized access.
You may not create an account for someone else, transfer your account, impersonate another person or organization, or use another person’s credentials without permission. We may require reasonable information to verify account ownership before helping recover or modify an account.
4. Acceptable use
FlashTalk exists for respectful language exchange and genuine conversation. You agree not to:
- harass, threaten, stalk, exploit, shame, or discriminate against another person;
- post or send unlawful, deceptive, sexually exploitative, hateful, violent, or privacy-invasive content;
- solicit money, passwords, financial details, intimate images, or other sensitive information through deception or coercion;
- spam users, conduct unauthorized advertising, or use the Service primarily for commercial solicitation;
- scrape, copy, index, reverse engineer, probe, or disrupt the Service, except where law expressly permits it;
- use bots, scripts, or automated systems to create accounts, contact users, or manipulate the Service;
- upload malware or attempt to bypass access, safety, rate, or privacy controls; or
- help anyone else violate these Terms.
5. Your content and conversations
You retain ownership of content you submit through the Service, including profile details, prompts, messages, voice notes, photos, and videos (“User Content”). You are responsible for your User Content and must have the rights needed to share it.
You grant Limbo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use your User Content only as reasonably necessary to operate, secure, improve, and provide the Service, comply with law, and enforce these Terms. This license ends when the content is deleted from our systems, subject to reasonable technical retention, safety records, legal duties, and content that remains in another user’s conversation history.
Messages and shared media are sent to other people. Recipients may save, copy, or share what they receive despite our rules or product controls. Use care and do not share anything you would not want a recipient to retain.
6. Safety, blocking, and reporting
FlashTalk provides controls such as contact boundaries, mutual photo reveal, blocking, and reporting. These tools reduce risk but cannot guarantee another person’s identity, intentions, conduct, or offline safety.
You are responsible for your interactions with other users. Use caution before moving a conversation elsewhere or meeting in person. If you believe someone is in immediate danger, contact local emergency services.
We may review reports and relevant account or conversation information, restrict features, preserve evidence, remove content, or notify appropriate authorities when reasonably necessary for safety, enforcement, or legal compliance. We are not obligated to mediate private disputes.
7. FlashTalk intellectual property
The Service, including its software, visual design, creature artwork, trademarks, text, and other materials supplied by Limbo, is owned by or licensed to Limbo and protected by intellectual property laws. These Terms give you a limited, personal, revocable, non-transferable, non-exclusive right to use the Service for its intended purpose.
“FlashTalk,” our logos, and related marks may not be used without our written permission. Feedback you voluntarily provide may be used without restriction or compensation, but we are not required to use it.
8. Third-party services
The Service relies on third-party infrastructure and may link to services we do not control. Their availability and practices are governed by their own terms and policies. We are not responsible for third-party services, but we remain responsible for our obligations under applicable law when we use providers to process information for us.
9. Suspension, termination, and deletion
You may stop using FlashTalk at any time and may request account deletion by emailing support@flashtalk.co.
We may restrict, suspend, or terminate access when we reasonably believe you violated these Terms, created risk or legal exposure, repeatedly infringed rights, or used the Service in a way that harms users or the Service. Where appropriate, we may provide notice or an opportunity to appeal, but urgent safety or legal circumstances may require immediate action.
Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnity, and governing law—will continue to apply.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Limbo disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee uninterrupted or error-free operation, specific learning outcomes, the accuracy of user-provided information, successful matches, or the conduct or identity of any user. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
11. Limitation of liability
To the fullest extent permitted by law, Limbo and its directors, employees, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service.
To the fullest extent permitted by law, our aggregate liability for all claims relating to the Service will not exceed the greater of US $100 or the amount you paid Limbo for the Service during the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
12. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Limbo and its affiliates, directors, employees, and agents from claims, losses, liabilities, and reasonable costs arising from your User Content, your misuse of the Service, your violation of these Terms, or your violation of another person’s rights.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Unless applicable consumer law requires otherwise, you and Limbo agree that disputes relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and each party consents to those courts’ jurisdiction.
Before filing a claim, please contact support@flashtalk.co so we can try to resolve the issue informally. Nothing here prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.
14. Changes and general terms
We may update these Terms as the Service or law changes. We will post the revised Terms and update the “Last updated” date. If a change materially affects your rights, we will provide additional notice when reasonably required. Continuing to use the Service after revised Terms take effect means you accept them.
If any provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, sale, or by operation of law. These Terms and the policies they reference are the entire agreement about the Service.
